Injuries & Accidents: Product Liability

Product Liability is a branch of law which deals with the responsibility of a manufacturer or seller to the consumer. Basically the manufacturer or seller has to warn the consumer of any defects or dangers in the product they have made. A product is defective if it causes damage or injury to the consumer by way of a defect in the product itself, its labeling or marketing, or in its use.

In legal terms, products liability is the liability of any or all parties along the chain of manufacture and sale of any product for damage caused by that product including the maker of the component parts, the assembler, the wholesaler, and the retail store owner. Any product that causes harm to the consumer due to defects can be the subject of a products liability suit.

If you have been injured because of a defective product, it is important that you take action to ensure that you recover fair compensation for your injuries from the product manufacturer. Even though products liability cases are extremely complex, expensive to prosecute and vigorously defended by manufacturers, our qualified Personal Injury attorneys have the experience necessary to recover substantial damages for our clients injured by defective products.

At Case & Dusterhoff, LLP, these types of cases are handled by James D. Case, R. Bruce Dusterhoff, Benjamin O. Falk, and Alex Golubitsky.
